Rental Agreement
This is a contract between Kharis Midwifery, LLC (the “Supplier”) and _______ (the “Renter”).
Rental Period

The rental period (the “Contract Period”) will be the earlier of:

a maximum of six weeks from the Birth Pool Delivery Date (usually 4 weeks prior to the Estimated Due Date); or
-
from the Birth Pool Delivery Date until a maximum of 48 hours after the birth has occurred, unless pre-discussed arrangements have been made.

There will be no reduction of the rental fee if the pool is returned before the end of the Contract Period.
Pool Usage

It is important to familiarize yourself with the pool and accessories prior to the onset of labor. Read and follow the instructions included with the pool. Practice setting up the pool to familiarize yourself with the process. Check that the faucet/shower adapter will fit a water outlet in your home. Our included adapters fit most standard faucets/showers or washing machine connections. If it does not fit yours, you must find an alternative at a hardware store or online.
Pool Breakdown & Clean Up

Kharis Midwifery, LLC points out that there is a safety and hygiene risk if a pool remains filled for periods longer than 48 hours and recommends against this.

Renters are required to drain the pool themselves within 12 hours of usage.

Prior to its return, the pool and accessories should be cleaned and dried by the Renter (see the included Cleaning Procedures manual). An additional charge will be incurred if the pool or its accessories require additional cleaning beyond typical sanitization.
Liability Waiver

Kharis Midwifery, LLC and/or its agents, members, employees and associates, as well as the pool manufacturer, are hereby released and held harmless from any and all responsibility or liability for the following:

maternal and infant complications, including mortality or morbidity, or
-
illness or injury of any and all persons connected with the use of the rented pool, or
-
physical property damage to any or all persons connected with the use of the rented pool, that may occur before, during and/or after labor and birth.

Renter agrees to release and hold blameless and indemnify and save harmless Kharis Midwifery, LLC and its agents, employees, successors, assigns, officers, directors and associates, as well as any pool manufacturer, from any and all manner of actions, causes of action, proceedings, suits, debts, expenses, general damages, special damages, costs of defending any claim on a solicitor and own client basis, interest, claims, demands, responsibility and liability for maternal complications, infant mortality or morbidity, or injury to any or all persons and facilities connected with the use of the rented pool that may occur before, during and/or after labour and birth in the pool provided, including for any injury or illness or damage that may occur as a result of the pool remaining filled until Renter has been able to drain it, and including for any injury or illness to persons or damage to any property whatsoever that may occur as a result of or in the course of the pool being drained by any party and including for any damage or liability arising from the condition or strength of the floor structure in the residence in which the pool is filled or for any breach of terms of a residential tenancy contract or regulations of a landlord or the building in which the residential unit is located resulting from the placement and use of the pool within that residential unit.

Without restricting the generality of the foregoing, Kharis Midwifery, LLC will not be liable for any damage caused by improper use or misuse of the pool or its equipment or as a result of damage to the pool caused by its use, or as a result of its use in a room that does not structurally support the use of a birthing pool.
Service Area
My service area is limited to North Texas and surrounding areas within 50 miles of Rowlett. If you are outside this area, don't hesitate to get in touch with me to discuss your options.
Fees
This service fee is $250, which includes a birth pool, fitted liner, air pump, sump pump, fish net, thermometer, universal tap adapter fittings (you may require a different fitting, in which case you need to supply the adapter), and a garden hose. You can add on a flower-shaped floor covering for an additional $30. In all cases, I request a nonrefundable payment of $250 upon signing this contract. Payments may be made online via Zelle to shanna@kharismidwifery.com or Venmo to @shannahinrichs. If you need to pay in another form, please let me know to make arrangements.
Refunds

Upon receiving the contract and payment, all birth pool reservations are NON-REFUNDABLE. Regardless of whether the pool is unused, the Renter changes their mind, or if birth plans change and usage cannot happen. By submitting the contract, the Renter reserves the pool, which holds the place for its rental, which can prevent other possible renters from using the pool. Therefore, upon submission of the contract, Renters are aware that all monies paid are NON-REFUNDABLE in all circumstances.
By signing this contract, you acknowledge that you have read, understood, and agreed to its terms and conditions.
